The European Commission has published Delegated Regulation (EU) 2026/1829, amending Annexes II and III to Regulation (EC) No 853/2004 on specific hygiene rules for live bivalve molluscs. It updates the information that must accompany batches as they move between operators, as well as the registration document template.
The main change is the introduction of TRACES for these movements. Operators will have to issue the registration document through the system, while recipients will be required to confirm the batch’s arrival. This requirement will apply from 19 November 2028, two years after the regulation enters into force, which is scheduled for 19 November 2026.
The regulation also formally defines re-immersion as an activity carried out by authorised intermediary operators that store live bivalve molluscs in clean seawater after harvesting to maintain their vitality.
It also clarifies that an identification mark is not required for live bivalve molluscs sent unpurified by an authorised intermediary operator to another operator, regardless of the classification of the production area. This exemption applies to movements between operators and does not mean that the molluscs are fit for retail sale.
